What Is The Purpose Of Equal Opportunity?

Title VII of the Civil Rights Act of 1964, as amended, prohibits employment discrimination on the basis of
 COLOR, NATIONAL ORIGIN, RACE, RELIGION, SEX (Gender/Sexual Harassment)
Additional Basis for Civilians
AGE (over 40), DISABILITY (mental/physical)

Who Is Covered Under EO Laws?

  • Appropriated Fund and Non-Appropriated Fund civilian employees, and applicants for employment have the right to file a complaint of discrimination
  • All military members assigned to the 325th Fighter Wing, TAFB or Associate Units with an active host tenant agreement

Authority – Title VII of the Civil Rights Act (as amended)

  • The civilian EO process operates under the authority of the Equal Opportunity Commission Regulated by the 29 Code of Federal Regulations  (CFR) Part 1614
  • The military EO process operates under the authority of AFI 36-2706

Guidelines for Civilian Reporting

  • Aggrieved  civilian who believe they have been discriminated against on the basis of Age, Color, Disability, National Origin, Sex, Race, or Religion, must consult with a Counselor  prior to filing a complaint, in order to try to informally resolve  the matter
  • An aggrieved person must contact an EO Counselor within 45 days of the date of the matter alleged to be discriminatory, in the case of a personnel action, within 45 days of the effective date of the action
  • Bargaining unit employees may elect to file under the negotiated grievance procedure, however an employee may not file a grievance and an EO complaint on the same issues
  • During the initial phase of the EO process, complainants have the right to remain anonymous (but anonymity is lost if/when the complainant files a formal complaint)
  • At any phase of the process the complainant has the right to a representative
  • There are two main phases of the civilian EO administrative process;  pre-complaint process (or informal), and the formal complaint process
  • At the complainant’s option, a complaint can progress to U.S. District Court

Guidelines for Military Reporting

  • Prescribed by statue and military policy (AFI 36-2706).
  • Members are encouraged to use the chain of command to identify and correct unlawful discriminatory practices
  • Informal: The individual may resolve the complaint on his/her own, request intervention from a co-worker, use the chain of command, or use the Alternate Dispute Resolution (ADR). 
  • Formal: Complaint is filed and addressed by the EO office.  The complainant has 60 days from the time the alleged behavior occurred to file a formal complaint.  The complaint clarification process includes interviewing or taking statements from persons (complainant, witnesses, and alleged offenders) who may have information relevant to the complaint,  and gathering data from records or reports.
